@#@#$!$!@$@#@# sigh... washing my car is becoming torturous. Found marks on my grille and on my hood like someone lightly keyed it. My lip is cracked in two places

Mazda Canada has chosen to deny coverage on the faulty turbo seals and the excessive paint fade on my car. I'm highly disappointed, considering the issues surrounding both.
I'm not sure whether to pursue a lawyer or sell the car at this point.

Indeed. And this foreshadows what could go wrong for other MS3 owners in BC as well. You may think your car is not smoking, but the two catalytic converters may be masking the problem. And if you have any aftermarket modifications to your engine or exhaust, expect a similar response.
This reminds me of the RX-8 engine replacement issue. Mazda knows there is a problem, and has quietly changed the part number for the turbo without issuing a recall.

Regarding the turbo, I've only been given a blanket statement that I have modifications. I'm not sure if Canada has something similar MAgnuson Act (in the US) regarding the need for the manufacturer to explain how a modification has resulted in the faulty part.
Sorry to hear that, buddy. Unfortunately, there's no such law in Canada. And I am afraid that hiring a lawyer for this regard will be futile. Compared to the US, Canada's judicial and legislative branch is very small, so it doesn't have a specific automotive sales and warranty act. Automotive warranty falls in the realm of the regular sales of goods act, which effectively exempts manufacturers from any warranty liabilities and obligations of any kind whatever when the warranty term is breached by the car owner. Unfortunately for us, modifying a vehicle is a breach of a warranty term. I am sure a lawyer would say something similar to you. Perhaps, it is best to save the soliciting fees and spend it towards future repairs. There's actually a guy in Manitoba with a MS6 that had his turbo replaced under warranty because of smoking seals. His name is mazdaspeedguy on the mazda6 forums.

Yes, and there are a several MS3 owners in Canada and North America with and without modifications who have had their turbos replaced as well.

A different manifold, fuel pump, engine management on top of the same mods I have. Yet he is covered, and my issue is somehow caused by mods. This is not the first car I have heard of either, with more mods then me getting covered. Sigh. I'm speechless. Kev
